During development
of the project, more than 500 claims submitted by various international
contractors form Brasil, Norway, Italy and Mexico, who took part in
the construction of the project were analyzed and evaluated. Additionally,
advisement and support was provided to the owner during both the Court
of Arbitration proceedings, constituted under the Independent Arbitration
Regulations, and the International Chamber of Commerce. The above claims
included topics such as delays, fast-tracking, suspension and/or upsets
to the works, reduced efficiency, inadequate designs and adjustment
formulas. The total amount of the claims was over US $140 million. The
first Court rejected all of the Contractor’s pretensions and ruled
payment on his part of Court proceedings costs. |
